Some media outlets are calling it a tobacco tax, while others just say cigarettes, but looks as if non-Native Americans are going to have to pay tax on at least cigarettes, and possibly cigars, purchased on the Reservations:

"The governor, sources said, today will sign a measure to begin collecting taxes on cigarettes sold by Indian retailers to non-Indians, raising the prospect of both big new revenues for the state and major confrontations with angry Indian protesters."
The measure would require wholesalers to attest, under penalty of perjury, that they have not sold tax-free cigarettes to any retailer. Manufacturers would then, in turn, only supply those wholesalers who make those assurances.
How are they going to determine if your a non indian?

hey Magnum.......a little off topic here, but I was wondering about the cigar bars in Buffalo. I was there a few years ago working at a hospital a few miles out of town, and I spent probably three weeks there. Anyway, I thought that it was odd that you couldn't smoke anywhere except in designated cigar bars.... I drove all over Buffalo trying to find one, and finally did that played some pretty good blues music. Why can you smoke is some bars, but not others?

The NY smoke free air act banned indoor smoking pretty much everywhere except private residences and cigar bars. Here's their def'n of a cigar bar:

Cigar bars that, in the calendar year ending December thirty-first,two thousand two, generated ten percent or more of its total annualgross income from the on-site sale of tobacco products and the rental ofon-site humidors, not including any sales from vending machines, and isregistered with the appropriate enforcement officer, as defined insubdivision one of section thirteen hundred ninety-nine-t of this arti-cle. Such registration shall remain in effect for one year and shall berenewable only if: (a) in the preceding calendar year, the cigar bargenerated ten percent or more of its total annual gross income from theon-site sale of tobacco products and the rental of on-site humidors, and(b) the cigar bar has not expanded its size or changed its location fromits size or location since December thirty-first, two thousand two;
Oh, and thank the heavens this new law doesn't affect cigars!

I talked to Jason today,the tax is only for cigs. as far as he knows.
many govenors have tried this in the past with bad results, I expect the same.Start burning the tires on the thruway I say!!!![thumbsup]
