The outlet and wiring need not be more than the breaker rating.
DO NOT replace that breaker with a higher rated breaker. That's the first step to burning down your house.

So I had an electrician buddy of mine come over today and he diagnosed the issue we hope. The new side of the basement is on the same breaker as a GFCI outlet in the electric box. It was wired incorrectly...not in a way to cause a fire but the blacks needed to be swapped or something. so far so good...hopefully this fixes the issue from here on out!

Figure out what outlets are on what breakers and mark them in the box. Sounds like you have too many things on a certain breaker. Easiest way is to have someone upstairs and you start shutting a breaker at a time to see what goes off/on.
